Last summer I bought a Berkley night fishing light from Walmart and took it to the lake that night.  It was the fluorescent type that had a black light and a white light.  It had two suction cups on the bottom for sticking it on the gunwales.   I got to the lake, took it out of the box and plugged it in.  It worked good and I used it for a couple minutes before we decided to motor to another spot.  I turned it off, pulled it off the gunwale and laid it upside down on the front deck of my bassboat.  After motoring about a quarter mile, we smelled that dreaded electrical fire smell!  I stopped immediately to investigate and found that my brand new fishing light on the deck of the boat was in full meltdown mode  It was laying upside down and when I turned it over there was a melted spot on the light and a two inch diameter melted hole in my boat carpet!  I called Berkley the next day and after some time spent emailing pictures and getting estimates ($1300 to replace my carpeting), I accepted a reparation offer totaling $850.  They mailed me a check for $500 and gave me $350 worth of product from any of their product lines.  The pic shows the $350 worth of product I chose.

 

So thanks to Pure Fishing for standing behind their product and not forgetting the "little guys" of the fishing world!

Those deep divers look like the Sebile D&S cranks.  An interesting concept on those.  I haven't tried them but have wondered how they work... Glad to see your new stuff...sorry to hear about your boat.

I don't agree they did you right.

The product's value is approximately 50% of retail if not less so for them to give you $350 of product means they actually gave you around $175 of product at their cost.

If the damage was $1,300 then they should have settled with you for $1,300.

However if you are happy with the settlment then we are happy for the settlement.

Those are D&S cranks. They claim to go 20-28 ft. deep and I like the single hook design to reduce hangups (I hope). I have a few spots that are fish magnets but just eat up cranks because of the deep laydowns. These are all baits that I've wanted to try but just haven't yet. I've been pretty impressed with sebile's story and innovative design. We'll see how they perform.

The other cranks are additions to my cold water arsenal. Flatt shads and spin shads.

Oh, and Jeff, the boat carpet will probably get replaced this spring.

It didn't catch fire, but it probably would have if I would not have unplugged it right away. It has a melted spot on the top where it melted the hard plastic that was about 1/8 inch thick. I sent it back to Berkley for "forensic analysis".

It worked pretty good. I like the black light for summer. I think it would have helped keep the skeeters away. I never really got a chance to give it a real test though.

Well the quote was for replacing the carpeting in the entire boat. The damage is a two inch melted spot on the front deck. The carpet is not exactly brand new either. It looks new but it is used. I thought it was a good settlement considering those facts. Pushing for more money would have made me feel greedy.

After my last post I went to Cabelas website and put all the pictured products in my shopping cart just to see the value and I'm a little shocked to see its retail value is $504.84. I gave the Berkley rep a list to go from and told her that when she got to $350 to just stop. She sent me EVERYTHING on the list.

Yep. From a business point of view it is very important to settle a situation than to be sued for the damages.

A corporation must be represented by an attorney and at their hourly cost it is less costly to settle than go to court or answer any legal correspondence.

As stated previously, if you are happy then we are happy.

I'm starting to agree with Sam, although I feel Pure Fishing did offer more than most other companies would.  The question is this, can you get your carpeting looking exactly the way it was before their defective product caused a burnt spot for $500.  If so or the spot doesn't bother you,you did ok.  If not the full $1300 for carpet replacement would have been more in line.  The lures, regardless of the retail value are basically a goodwill move.  As Sam says 50% of retail, IMO probably no much than $100 in their cost, besides how much could you resell those lures to help in the cost of carpet replacement, not to mention the inconvenience in doing so.  Would a case like this go to court, probably not but if so you being the plaintiff wold probably have to file papers in their jurisdiction, meaning you travel there or get an attorney to do it for you.  Even if you win, you still have lost considering expense and travel.

I think Pure Fishing got off for $600, no more than $700 and you got a hole in your carpet.

Hey Scrutch.  Think about plugging the hole.  Find a carpet that is an acceptable match and buy a small piece, or remnant if you can.  Place it over the damaged area, line up the nap, and secure it in place.  Small screws or brads should work. 

 

Use a straight edge and a sharp utility knife, and cut through both carpets.  You might need a few passes with the knife to cut cleanly through both pieces.  Remove what you used to hold the "patch" in place, then set the patch to one side, keeping its orientation the same.  Remove the damaged piece, and clean any remaining adhesive.  Apply carpet adhesive according to directions, then fit the patch into place, and use something like a wallpaper roller and press the patch securely into place.

 

To give it the weathered and worn look of the old carpet, scuff it with a wire brush until it's has the slightly worn appearance of the existing carpet.

 

It's not likely that you'll get a perfect match, but it will be preferable to a crispy melted area, and will only cost a few bucks and some time.

Pure fishing already has a  legal department. The last thing they want to do is get in a legal battle because it is bad with PR. Hence why they gave him the free gear. Pure fishing could have had this case wrapped up in court for years if they wanted to .

A good idea Tom thanks. The jury is still out on whether to patch it or get new carpet in the entire boat. You've seen my boat and know that the carpeting looks pretty good but there are a couple areas (like under compartment lids) that it is getting worn. Between the seats on the cooler lid is the worst. it is getting brittle and beginning to come apart under the lid. I assume all the carpeting is getting brittle too and if I didn't replace it this year I might start to see some more spots appear. Maybe not though. It might make sense to wait. Like I said, the jury is still out.

I'm really surprised they went so far to replace items damaged by the defective product.  Warranties usually exclude this kind of liability.  Nice to hear of them doing the right thing, though.  Spares you an insurance claim.

Lesson learned, never trust a volt setup without an inline fuze. I did the same thing with neons in a competition vehicle when I was young.

Glad they made it right in your eyes.  Did the ysay there were other problems or ask you send in your defective unit?  Are they planning on fixing the issue on further sales?

 

To me that is standing by their product.  What they did is great but they need to fix the problem and not just throw some free baits and some cash people's way.  Just imagine what could have happend if it was when you docked the boat at night.....you wake up in the middle of the night to see your boat in flames.

I sent the light back to them for analysis.  They said their engineers wanted to examine it. 

And yes, I am really lucky I didn't plug it in inside my garage and go to bed.  No boat AND no house (maybe no ME!).  Then my attorney (who is also my WIFE) might have been involved!

I think that they were very fair, more than they were legally liable for. I doubt seriously if someone left a cell phone or GPS unit hooked up in a vehicle that Verizon or Garmin would replace the car should it short out and cause a fire.

Warranties cover replacement of the defective product, but this goes a bit further.  Where injury or property damage has been caused by a defective product both consumer protection laws and property liability laws allow the damaged party to seek compensation for the loss.  The question is how much, for example if the entire boat would have caught on fire would he be entitled to a brand new boat, probably only replacement value and that would be determined by evidence of the value.  Additionally boat insurance or HO insurance may cover the claim.  Dealing with an amount of $1300 would rule out insurance claims or legal action (small claims is best bet), unless it's a matter of principal and the money is a secondary concern, which doesn't seem to be the case.  Had the damage not occurred the carpet may have been replaced in a year or 2 anyway, settlement was the best way to resolve this issue.

When adversity strikes we aren't always happy with the outcome, sometimes ya just gotta deal with it.

We are beating a dead horse he made off fine. $1300 for the entire cartpet to be repaired is fine but he could get away with a section being replaced for much less. My suggestion is a $100 decal to put over the spot. It looks cool and covers the spot.
