Haha. I was with him there when we got kicked. Some larger, black woman came up to us and told us there was a sign that said no fishing. We asked her where the sign was. She said " It's here somewhere." We just started laughing at her and left. But we stayed at the same lake at another spot where we caught more largemouth. Fun day overall!

LOL! Yeah we know eachother. I introduced him to the forums a few months ago. We were at a friend's house in a gated community. Our friend has lived there for a few years and always goes fishing in his backyard for pea's. Well Weston caught the largie and some guys in a golf cart passed us a gave us a look. Not more than 5 minutes did the woman come and tell us to leave. I guess he reported us. The community definetly allows fishing because no where around the entire lake are there no fishing signs. She also said do you guys live here and we told here yeah and she kind of hesitated to answer us back and said we still had to leave. Doesn't matter. We'll still go fishing there. You can't stop the pea chasing.

Nope. There aren't any big fish out in Miramar. :D

Fair warning, If you're asked to leave, it would behoove you to beat feet. The Miramar PD usually has cops at the workstations in each development. Good guys for the most part, but their kind of hamstrung by the developments. There is public property bordering some of the lakes if you know where to look. Some communities may allow fishing, but that's specific to the residents and on their property. Each HOA will have its specific rules. Mine has no fishing signs posted inside of the development.

Hoa's are the absolute worst. Obviously anyone who has time to be a hoa official, or whatever u call it, has no life of their own. So they have to interject themselves into others lives. I'd have written permission from your friend who lives on the lake in your tackle box at all times. That way when u get approached by some crazy black lady you can ask her, "Im sorry, am I on your property?" If she says yes, leave. If she says no, tell her to "tick off, mind your own business." If she calls the cops, produce your note for them and they won't/can't kick u out. Works for me in Virginia. I actually had a guy try and call the cops on me because I was fishing from the shore around his floating dock. The cops came, I informed them I was a guest in the neighborhood. I then produced the note, and my fishing licence. The cops informed the a hole that not only was I allowed to fish there, but since it was a floating dock that was not connected to his property, I could technically even fish on the dock if I wanted. I was actually about to move on from that spot, but decided to chill and fish on this dock for a while. I still fish on that dock everytime I go to that lake.

Sometimes the HOA can be a pain but they are taking care of matters that most people don't want to deal with.  Landscaping companies, tree trimmers, painters, insect sprayers, just don't show up, it takes time to interview and hire them.  They deal with insurance companies, banks, attorneys and legal matters, residents mostly take all this work and effort for granted.  Sure they can be a pain, but they are doing something I don't want to do.

 

If one is in a private community having a letter of permission from a resident does not give the right to fish there without the resident.  There may be certain circumstances where one could fish, an example may be that part of the water is outside the community.  The residents pay to live there, as fishermen we may be trespassing.  Had it been a 6'5 250# male would you have laughed at him, or a security guard, or a member of the HOA?

To be honest, and I'm not trying to act like a "macho man" but yeah I probably would have still laughed. Mostly because we weren't laughing AT her, we were laughing at what she was saying. And what would being 6'5 250# do for him exactly? I'm not trying to be rude or anything to you, I'm just curious as how your looking at this scenario. :)

Real easy to say on line that you would have laughed at a person with a more authoritative physical look.

I'd pay to see that, lol.  To satisfy your curiosity I interpreted this scenario as a couple of immature people laughing at a large woman of color.  I quote " We just started laughing at her and left.  That does instill the notion that you laughed in her presence before leaving.  IMO not only is it immature but disrespectful and impolite.  By your own admission you said you lived there, that wasn't true.  Not only were rude to her but lied on top of it, all that for fish.

Yeah we did laugh in her presence. And yes my buddy did say he lived there, because he does. So it is true. We didn't lie. To add to that, she lied by telling us there was a sign, and I quote "somewhere in there". How do you not laugh at that? She works there, lies to us and says we can't fish there, then lies AGAIN by saying there was a sign saying there was no fishing allowed. We were on public property outside the community. I agree now looking back at it, that we were rude. But just a little. In no way was I immature. Laughing is immature? I can't connect those two. And yes. All for a fish. 

 

About the 6'5" 250# man, if I did laugh in his presence, what is he going to do? By analyzing your wording, the only scenario I can put together in my mind is a lawsuit. What being bigger makes you have more authority over someone? If that's how you see it then fine. But I don't think that way, that sounds like a bully to me. 

 

No disrespect to you, but I think it would be best if we stop replying to each other. It's probably only going to get worse.

Not such a thing. You were either on the HOA's property or in the right-of-way owned by the local government jurisdiction or FDOT. Here in FL being in land development I have the knowledge of the SWM maintenance agreements and such. 9 out of 10 the ponds and an easement around them go to the HOA and fall under HOA rules. There are some HOAs around here that post signs "no fishing behind homes" so you can fish but only the sides of the pond not built on. FWC even tells if the water was navigable in 1854 then anyone can be there, if it was dug out or made after that then people of the community or sole person on a canal can put up signs and it is considered private and you cannot fish.  My point is to educate you so you won't get in trouble. your young and last thing you and your friend need is a trespassing charge. Read the Florida statutes on the subject, when it becomes hunting or fishing and if you(or they say you take) fish/game from private property it can get serious really quick. I pond hop around here, No fishing signs I don't bother, If there are no signs but I get asked to leave then I don't come back, this happened once, and the signs were up in a week. Hope yall find another sweet spot to fish and stay out of trouble.

Thanks for this. Part of the lake we were fishing is part of his community. We were fishing maybe 20 ft from his backyard, not in someone elses yard but on the part that you can enter from the street, from outside his community. No signs what so ever. Even there we can't fish? Also he's been fishing there for about 4 years and no one ever has said anything to him. Except this time. It's a great spot to fish at and holds some trophy bass and peacock in there. But we are allowed to fish from his backyard correct?

Well we fish our community pond as do others, it really boils down to a few things. Where you are is under HOA rules, read the written rule book if it is not stated in there then you need to default to signage. If there are no signs or they are not clearly visible then you are ok for now(like with me I told them that one time, there are no signs and this is a community pond then the signs will show up if it that big a deal). Now when someone tells you to leave you can tell them to show you the signs, you read the rule book etc. as far as calling the cops it is an HOA property not a homeowner I dunno who actually would have to call them the HOA president or what, techincally your not tresspassing if it is your(firends whatever as long as one of you live there) community and in a HOA governed area. But once they post or clearly post the sign or write that rule then your done, they have ground to ask you to leave, fine you with an hoa fine,  or call the cops. But I am not a lawyer just defaulting to common land development practices so take my words with caution, read the community rule book first before you go back out. When you go back out check for signs and stay out of peoples back yards. 

 

Backyard you should be good but it can depend and they can get technical with it if they want. If there is an easement, the property ends prior to edge of water or a clear mow strip then they may/can say it is in there jurisdiction and no fishing.

Get your friend to get it....non property owners aren't supposed to get it....HOA care about apperrance, property value etc. you trampling their grass catching the fish they stocked looking all recreational is unsightly. People unknowingly or uncaringly forked over their rights to hoas so a bunch of narrow minded clueless nit-wits because they are too lazy to cut the fricken grass or to busy to take off work wait for the bug guy. HOA aren't good but they ain't going away and laws/rules are laws.

What would be the point in stocking a community pond and not letting people fish there?  I'm assuming that it has been stocked since Peacocks are an introduced species.  What is the point of building a pond for a community if not to fish?  Mosquito breeding?  I'd tell everyone that approached me to f off until I was approached by a cop.  Any "HOA laws" will not stand up in a court of law against a good lawyer anyways.  Especially if you have permission from a home owner.  It is after all the HOME OWNERS association.  The HOA in my neighborhood ticked a lawyer Home owner off so much that he basically took them to court and forced them to abandon most of their bylaws.  It's a townhouse community with two parking spots assigned for each home.  He apparently was getting nasty letters from the HOA because his extra car was always parked in visitor spaces.  Well now there is no assigned parking at all in the entire neighborhood and even though the spaces are numbered still, you can technically park wherever you want.  The lake in our neighborhood has signs all around it saying that it is for residents and guest use only which is fine with me.  In actuality, anybody can fish there because the dam was paid for by the county for drainage control.  The only reason HOAs think they have so much power is because nobody challenges them.  They assume that they actually have authority, and they don't.   Our HOA will soon be a civic association that pays only for landscaping in common areas, and that is fine with me.

In none of the previous posts there was no indication that you were fishing with a homeowner.  Had that been the case just by producing some ID, you would not have been asked to leave.

The rule books are called "DOCS" (short for documentations) and for the simple fact there is no reason for a non resident to have them at all.  In the event a person is fishing outside the gates of a community, it's quite possible that the community still owns that property and one would still be trespassing.  A simple check of the county's appraiser site will indicate who owns what, that's public information.  I don't check out that information myself, but if there is an issue, the legality can easily be obtained.  For the most part if one is fishing away from the homes there is usually no incident.

 

In a gated community the HOA has total control of who can be there.  Pretty normal to produce ID at the security gatehouse, not unusual for security to call the home owner to make sure it's legit visit.  Security is there for the protection of the homeowners, and recreational areas such as a pond are for the enjoyment of the people that pay to live there. In my community for example I own property up to a certain point, that does not include the shoreline of the ponds.  Any resident can fish that pond even though it's behind my home, I certainly don't want an outsider there, is that person fishing or casing the place out?  I'm sure the intentions were for fishing only, but residents don't care about fishing too much, they care about their security and privacy.  You don't live there, you don't belong there.

Wet ponds get stocked as a requirement for mosquito control. Carp are often stocked as weed control. Unless an FWC/state pond most time bass aren't stocked. Fisherman and other folks put them in there. The peas are in there because the pond has a open pipe outfall due to the constant high water unlike control structures up here. Fish can swim back n forth.

I guess I've should of read my DOCS when I first moved in. I've been passing up some ponds in my HOA community because half of it had houses on it. I tried one pond one day and a woman came to her window and was giving me funny looks across the pond, so I just left. I've took it out a few times and glanced at it but it's about 300 pages of rules.

I read my docs cover to cover and more than once.  When I first moved in a situation happened, it was ugly and I won't get into the exact details.  A day or 2 later the HOA board member that hassled me apologized.  There have been a couple of other incidents due to residents not knowing what's in the docs.  In my community I can fish anyplace according to the rules, but I cannot walk thru an owners property, I have to enter thru the common areas.  Living here for as long as I have with many friends most people don't mind me walking on their property, but there are some that have been quite vocal about me not doing it.
